OBJECT

BITSA® puts at your disposal, through the BITSA® application, an online marketplace (hereinafter MARKETPLACE) that enables you to purchase digital products from external suppliers to BITSA®, at prices and conditions established by them. The purchase of these products is made with the intermediation of BITSA®, which hosts the MARKETPLACE in the app and receives the payments you make on the supplier’s behalf.

You will not be able to access this MARKETPLACE if you are subscribed to the FREE plan.

Through the MARKETPLACE you can acquire digital codes (hereinafter cards) that contain stored value for subsequent redemption on the supplier’s platform, allowing you to enjoy the good or service provided by the supplier by entering the PIN we supply for that purpose.

These terms of use, sale and information (hereinafter the Conditions) regulate both your rights and obligations as a user and BITSA®’s rights and obligations as intermediary in the sale of supplier products, regarding access to and use of the MARKETPLACE, as well as the conditions applicable to the purchase processes you carry out for the cards offered therein.

ACCEPTANCE, PERIOD OF VALIDITY AND MODIFICATION

Browsing the MARKETPLACE, purchasing any card, as well as receiving cashback means you accept the Conditions in force at that moment. Nevertheless, when you make your first purchase or whenever we publish any modification, we will ask you to expressly accept them.

For all matters not covered herein, the General Conditions of Access and Use of the Website and Application, the Terms and Conditions for Issuing the BITSA® Card and Use of the Payment Services, and the Privacy and Cookies Policy shall apply.

We recommend reading those texts together with these Conditions (collectively, the BITSA® Legal Texts) before taking any action. The Conditions remain in force indefinitely, especially while they are accessible through the BITSA® app. However, we reserve the right to modify them in whole or in part whenever we deem it necessary for the proper functioning of the MARKETPLACE; such changes take effect once published.

Therefore, before browsing, please read the Conditions carefully. Accessing and using the contents and services after modifications implies your acceptance. Changes have no retroactive effect.

ACCESS

Only if you are a registered and verified BITSA® card user and are not subscribed to the FREE plan can you access the MARKETPLACE. Once in the BITSA® app—via password or biometric identification—you will see the MARKETPLACE icon. We will deem all accesses and purchases you make as valid, and you are responsible for safeguarding your credentials and device.

However, we reserve the right to refuse or cancel your purchase orders if:

  • You have any litigation, legal proceedings or claim in progress with us.
  • We have been forced to block or cancel your BITSA® card because you have previously violated any of the terms or conditions included in the BITSA® Legal Texts.
  • We have been forced to block or cancel your BITSA® card because you have been involved in any type of fraud.
  • We have been forced to block or cancel your BITSA® card because you have provided false, incomplete, outdated or inaccurate identification data, or failed to send documents required under anti-money-laundering regulations.
  • We have been forced to block or cancel your BITSA® card for any other reason foreseen in the BITSA® Legal Texts.

PROCESS AND CONDITIONS OF PURCHASE

After accessing the MARKETPLACE we will ask you to indicate the geographic area where you will redeem the digital content so we can show available cards for that area. Cards appear in categories (videogames, TV, top-ups, etc.) and each includes a description with requirements and technical specifications provided by the supplier.

Select the card you wish to purchase and confirm to continue. We will display a summary box with:

  • Product name
  • Card type
  • Country of exchange
  • Price
  • Discount, if applicable
  • Total price to be paid

Prices are shown in Euros (€) and include all applicable taxes and fees.

We are not responsible for computer, manual or technical errors that cause a substantial alteration in the retail price displayed; if the price is exorbitant or manifestly derisory, the purchase price will be invalid and cancelled, and we will inform you as soon as possible. Given that cards are digital content without physical support, we do not accept returns, a fact highlighted in the summary box where you must verify your data before paying.

Confirming and paying implies you expressly accept the no-refund policy and the loss of your right of withdrawal. Payment is charged to your BITSA® card. Once the charge succeeds, you can access the PIN needed for redemption on the supplier’s platform. The PIN is usually available immediately in My Purchases; if not, please wait 24 hours and contact Customer Service if it remains unavailable.

EXCHANGE DIGITAL CODE or PIN

To obtain the desired product you must access the supplier’s platform and redeem the PIN provided. Note that:

  • You can redeem the PIN only once; it is single-use.
  • You can redeem it only on the supplier’s platform.
  • The supplier will state the time period for redemption. If you do not redeem it within that period, the PIN will expire and you will have no right to refund or compensation from us or the supplier.
  • You must accept the supplier’s terms and conditions.

What if an error prevents redemption? If the PIN error or any doubt arises about the digital content purchased, please contact the supplier’s customer service. Links to suppliers’ websites will be available in the app.

CASHBACK

Thanks to our cashback you can benefit from discounts of up to 15 % on MARKETPLACE purchases, through commercial agreements with the companies offering their products or services. The discount percentage appears when you select the product or service.

LIMITATION OF LIABILITY

As stated, BITSA® acts solely as intermediary, providing digital codes for later redemption on the supplier’s platform, allowing access to the desired good or service.

Therefore:

  • Your contractual relationship with BITSA® ends once we make the digital code or PIN available to you. BITSA® is not part of the purchase-sale contract perfected when you redeem your PIN on the supplier’s platform.
  • Products are the sole responsibility of MARKETPLACE suppliers regarding ownership, quality, safety, functionality, warranty and legal compliance. Any claim must be addressed directly to the supplier; BITSA® is exempt from liability.
  • Price and terms of sale and use (geographic scope, technical specifications, etc.) are the responsibility of suppliers. Information is provided by the supplier and published by BITSA®. We accept no liability for discrepancies or later changes after purchase.
  • Ensure the digital content applies to your geographic area and meets technical requirements; once purchased, cards are non-returnable.
  • Although we work with reliable suppliers, we are not liable for defects, unavailability, damages you may suffer, or any legal non-compliance by the supplier.

CUSTOMER SERVICE

Through the MARKETPLACE we only provide a space for acquiring digital codes or PINs with stored value for later redemption on the supplier’s platform.

The supplier is responsible for selling its products and assisting you regarding that content. Our Customer Service team will help with payment-related errors.
